Terms of Service — Maple Hearth Culinary Studio

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services, facilities, classes, workshops, events, websites, booking systems, communications, and related offerings provided by Maple Hearth Culinary Studio (“Maple Hearth Culinary Studio,” “we,” “us,” or “our”).
By booking, attending, purchasing, registering for, or otherwise using any service offered by Maple Hearth Culinary Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional policies, waivers, safety instructions, or event-specific rules communicated to you from time to time.
If you do not agree to these Terms, you must not use our services or attend our premises or events.
2. Scope of Services
Maple Hearth Culinary Studio provides culinary education and event services, including but not limited to:
- Hands-on cooking classes for adults;
- Private group cooking workshops;
- Corporate team-building culinary events;
- Date night cooking experiences; and
- Kids and teen cooking sessions.
Services may be delivered at our studio, at a third-party venue, or through other arrangements specified at the time of booking. We may modify class content, recipes, instructors, schedules, ingredients, equipment, and formats as reasonably necessary for operational, safety, seasonal, or supply-related reasons.
We do not guarantee that any specific recipe, ingredient, dietary accommodation, instructor, or event format will always be available.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information when booking or registering;
- Comply with all safety instructions, studio rules, and staff directions;
- Use equipment, utensils, appliances, and facilities responsibly and only as instructed;
- Inform us in advance of any allergies, dietary restrictions, medical conditions, mobility concerns, or other special requirements that may affect participation;
- Supervise minors at all times unless we expressly state that supervision is provided by Maple Hearth Culinary Studio;
- Ensure that you and any guests you register are fit to participate in the activity;
- Refrain from disruptive, abusive, unsafe, discriminatory, harassing, intoxicated, or unlawful conduct; and
- Respect the property, equipment, intellectual property, and rights of Maple Hearth Culinary Studio, its staff, instructors, guests, and other participants.
You are solely responsible for determining whether participation is appropriate for you or any guest, including in light of allergies, food sensitivities, pregnancy, medical conditions, or other personal circumstances. While we may attempt to accommodate dietary needs, we cannot guarantee an allergen-free environment.
If you attend with minors, you represent that you are the parent, legal guardian, or authorized adult responsible for the child, and you consent to the child’s participation and to these Terms on the child’s behalf to the extent permitted by law.
4. Payment Terms and Conditions
All prices are stated in Canadian dollars unless otherwise indicated. Applicable taxes, fees, and charges may be added at checkout or invoiced separately, as required by law.
- Payment is due at the time of booking unless otherwise agreed in writing.
- We may require a deposit, full prepayment, or a valid payment method to secure a reservation.
- Bookings are not confirmed until payment is successfully processed and you receive confirmation from us.
- If a payment is reversed, declined, charged back, or otherwise not received, we may cancel the booking and deny participation.
- For corporate, private, or custom events, additional terms, minimum spend requirements, and invoicing schedules may apply.
You authorize Maple Hearth Culinary Studio and its payment processors to charge the payment method provided for all amounts due in connection with your booking, including taxes, cancellation fees, no-show fees, damage charges, and other amounts permitted under these Terms or agreed in writing.
5. Cancellation and Refund Policy
Our cancellation and refund policy may vary depending on the type of service booked. The specific policy applicable to your booking will be disclosed at the time of purchase or in your confirmation email. If no specific policy is stated, the following default policy applies:
- Individual classes and public sessions: Cancellations made at least 7 days before the scheduled start time may be eligible for a refund or credit, at our discretion, less any non-refundable processing fees where permitted by law.
- Cancellations made less than 7 days before the event: May not be eligible for a refund, but we may offer a transfer, credit, or rescheduling option at our discretion.
- No-shows: No refund or credit will be provided for failure to attend unless required by law or expressly approved by us in writing.
- Private, corporate, and custom events: Deposits may be non-refundable. Cancellation timelines, minimum notice periods, and rescheduling terms will be set out in the booking agreement or invoice.
- Studio cancellations: If we cancel or materially reschedule an event, we will use commercially reasonable efforts to offer a refund, credit, or alternative date, as determined by us and subject to applicable law.
Refunds, where approved, will generally be issued to the original payment method within a reasonable time. We are not responsible for delays caused by banks, card issuers, or payment processors.
We reserve the right to refuse service, remove a participant, or cancel a booking without refund where necessary to protect safety, comply with law, or address misconduct, including intoxication, harassment, unsafe behavior, or failure to follow instructions.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Hearth Culinary Studio, its owners, directors, officers, employees, instructors, contractors, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of our services.
Participation in culinary activities involves inherent risks, including but not limited to burns, cuts, slips, falls, allergic reactions, foodborne illness, equipment misuse, and property damage. You voluntarily assume all risks associated with participation, except to the extent caused by our gross negligence or wilful misconduct, or where liability cannot be excluded under applicable law.
Without limiting the foregoing, Maple Hearth Culinary Studio is not responsible for:
- Allergic reactions or adverse health outcomes resulting from ingredients, cross-contact, or undisclosed sensitivities;
- Loss, theft, or damage to personal property brought onto the premises or to an event location;
- Injuries caused by failure to follow instructions, improper use of equipment, or unsafe conduct by participants;
- Delays, interruptions, or cancellations caused by third parties, suppliers, venue issues, weather, or force majeure events; or
- Any reliance on recipes, nutritional information, or culinary guidance provided during our services.
Where liability cannot be excluded, our total aggregate liability for any claim arising out of or relating to the services shall be limited to the amount paid by you for the specific service giving rise to the claim, to the extent permitted by law.
7. Intellectual Property Rights
All content provided by Maple Hearth Culinary Studio, including but not limited to recipes, handouts, lesson plans, written materials, photographs, videos, logos, trademarks, service marks, designs, graphics, and website content, is owned by or licensed to Maple Hearth Culinary Studio and is protected by applicable intellectual property laws in Canada and elsewhere.
You may use our materials solely for your personal, non-commercial use in connection with the services you attend. You may not reproduce, distribute, publish, sell, modify, create derivative works from, publicly display, or exploit our materials without our prior written consent.
Any feedback, suggestions, testimonials, or ideas you provide to us may be used by Maple Hearth Culinary Studio without restriction or compensation, unless otherwise agreed in writing.
You grant us a non-exclusive, worldwide, royalty-free license to use photographs, video, or audio recordings taken during events that include your likeness, voice, or participation, for promotional, educational, archival, or operational purposes, unless you notify us in writing before the event that you do not consent and we acknowledge such request in writing. For minors, consent must be provided by a parent or legal guardian where required by law.
8. Data Protection and Privacy
Maple Hearth Culinary Studio collects, uses, discloses, and retains personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
We may collect personal information such as your name, contact details, payment information, dietary preferences, allergy information, attendance records, and communications with us for purposes including booking management, service delivery, safety, customer support, marketing, accounting, and legal compliance.
We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We may share personal information with service providers, payment processors, instructors, venue partners, and other third parties as reasonably necessary to provide our services, comply with law, or protect our rights and safety.

9. Force Majeure
Maple Hearth Culinary Studio shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, fire, flood, severe weather, power outages, labour disputes, governmental actions, public health emergencies, epidemics, pandemics, supply shortages, transportation disruptions, venue unavailability, or failures of third-party service providers.
In the event of force majeure, we may postpone, reschedule, modify, or cancel services without liability except to the extent required by applicable law or expressly stated otherwise in a booking-specific agreement.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be effective when posted on our website or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services and, where applicable, cancel any future bookings in accordance with the cancellation policy.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your use of Maple Hearth Culinary Studio shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
Subject to any mandatory consumer protection laws or other non-waivable legal rights, you agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the services.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and enforced to the maximum extent permitted by law in a manner that most closely reflects the original intent of the parties.
These Terms constitute the entire agreement between you and Maple Hearth Culinary Studio regarding the subject matter herein, except where supplemented by a separate written agreement signed by Maple Hearth Culinary Studio.
